Reasons to Get a Background Check on Your Civil Lawsuit Recipient

Does a Lawsuit Show up on a Background Check? To the first, there is no sure way to determine whether or not it does. Probably not, although there are some exceptions.

Most background checks are only criminal, thus civil cases often do not. However, in a civil case, most documents relating to the plaintiff (the one initiating the lawsuit) will be disclosed. This includes divorce records, criminal, arrest and court records, etc. It also includes any prior litigation undertaken by the plaintiff and any court actions or judgments against the defendant.

So what does all this mean for someone who wants to file a background check civil lawsuit? First, if there was a prior lawsuit filed against the person you wish to obtain background information on, then it could come up during your investigation. The court may even release portions of that prior litigation if they deem it pertinent. Additionally, if you obtain information on a previous defendant through a background check, then it may come up during the lawsuit. You must be very careful when considering this, however. You do not want to discover information that will come back and harm you in any way.

So, what does all this have to do with criminal background investigations and how can they be used in civil litigation?

If a person’s life has been disrupted by civil law suits and they want to bring their attackers to justice, a background check can reveal relevant information regarding prior criminal activity. For instance, if the victim of a sexual assault had been previously attacked by the same person, the victim’s civil attorney might find relevant information regarding prior criminal filings. If you are involved in a civil lawsuit, you will want to obtain as much information as possible in order to determine whether or not the conduct was taken seriously by the opposing party and if the plaintiff was treated fairly. This is often crucial in determining if an individual is guilty of a civil lawsuit.

Unfortunately, many people do not understand that these types of lawsuits happen and civil cases can drag on for a very long time.

Many times, they drag on for years and sometimes even decades. It is during this time frame that employers can use background checks to discover whether or not someone with a clean slate has had previous run-ins with the law. In this way, they can make a decision if someone with a clean slate can be trusted with the responsibility of handling sensitive or potentially private information such as credit card numbers or social security numbers.

Employers also use background reports in civil courts as a means to discover any previous litigations that the potential candidate may have had against another person or company.

For example, if you are an employer and you want to hire someone to work around the home, you should inquire about whether or not the potential employee has ever been sued for personal injuries at another location. This will give you an idea of how litigious the person may be and whether or not he or she would make a good employee for you. It can also reveal information about any previous criminal past that may come up during the interview process.

Another great reason to obtain your own background check is to check up on your neighbors.

It could be that there are a number of individuals moving into your neighborhood and you would like to know their history before you allow them to move in. In civil litigation, it is very common for one party to sue another over civil litigation which was won by the plaintiff (i.e., the person who sued). Therefore, it is important to find out who your neighbors are and if they have any history of winning judgments against other individuals.

One more reason to conduct your own civil litigation background check is to check up on the past employers of someone you are interviewing for a job. While many employers will not have anything to do with the lawsuits that have been filed against an applicant, you may want to find out more about some of the people that have been terminated from their past jobs. Have they ever been involved in any civil judgment? These are just a couple of the many reasons why individuals will want to get their own background check done before they go through the hiring process.
